Terms of service.

These Terms of Service (the "Terms") govern your access to and use of the Confee website (confee.io), the Confee hardware product and the Confee companion application (collectively, the "Service"), all operated by Rosy AI, MB ("Rosy AI", "we", "us"), a private company registered in the Republic of Lithuania with its registered office in Vilnius.

By creating an account, joining the waitlist, purchasing the device or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

You must be at least 16 years of age to use the Service. By using the Service you represent that you are at least 16 years old and have the legal capacity to enter into a binding agreement with Rosy AI, MB.

When you create an account or join the waitlist, you agree to provide accurate, current and complete information and to keep that information up to date. You are responsible for safeguarding any credentials and for any activity that occurs under your account.

The Confee pendant is a one-time purchase. Title transfers to you upon delivery and full payment. The device firmware and companion application are licensed (not sold) to you under these Terms and any open-source notices included with the device.

AI processing, CRM sync and ongoing software updates are provided as a subscription service. The subscription term, billing cycle, and pricing are presented at checkout and on the Pricing page. You can cancel the subscription at any time; your subscription will remain active until the end of the period you have already paid for.

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, including data-protection and recording-consent laws in your jurisdiction.

You will not record any individual without disclosing that recording is taking place when applicable law requires such disclosure. The Confee device is engineered with a visible LED trust light and an in-app consent flow precisely to make compliant recording the default; circumventing those features is a breach of these Terms.

You will not use the Service to harass, defame, or unlawfully surveil any person, or to process special categories of personal data without an appropriate lawful basis.

Personal data you submit to the Service is processed under our Privacy Policy. You retain ownership of your conversation data, transcripts, structured lead records and any content you upload. By using the Service you grant Rosy AI, MB a limited licence to host, process and transmit that content solely as necessary to operate the Service for you.

You are responsible for complying with the consent and notice requirements of any conversation you record using the device.

The Confee name, brand, hardware design, firmware, companion software, marketing materials and all related intellectual-property rights are owned by Rosy AI, MB or our licensors. Nothing in these Terms transfers any of those rights to you, except for the limited rights expressly granted herein.

The Confee pendant carries a 24-month warranty against manufacturing defects. The warranty does not cover damage caused by misuse, unauthorised modification, water ingress beyond the rated environment, or normal wear and tear.

EU consumers benefit from a 14-day right of withdrawal from the date of delivery of the hardware. To exercise it, contact support@rosyai.lt before the period ends.

We aim to keep the Service available continuously, but we do not guarantee uninterrupted operation. Scheduled maintenance, upstream provider outages, or unforeseen events may cause temporary interruptions. We will give reasonable notice for planned maintenance where practicable.

To the maximum extent permitted by Lithuanian law, the total aggregate liability of Rosy AI, MB arising out of or in connection with the Service is limited to the amount you paid to us in the 12 months preceding the event giving rise to the liability.

We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that creates risk for us or other users. We will give you reasonable notice of suspension or termination where practicable, except where immediate action is required.

These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-law rules. The courts of Vilnius, Lithuania have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that consumers may bring proceedings in their country of residence where local law allows.

We may update these Terms from time to time. The "last updated" date below will reflect any change. For material changes that adversely affect your rights, we will give you reasonable advance notice (typically 30 days) before the new terms take effect.
